Who is Sun Life?
Sun Life Insurance Company is a division of Sun Life Financial, a financial services provider based out of Canada. Sun Life Financial has more than $125 billion in assets under administration, with more than $1.3 trillion in assets under management internationally, and ranks number 235 on the Forbes Global 2000 list for 2022. Sun Life Insurance is a leading provider of life and disability insurance, providing insurance and financial services worldwide. In the U.S, Sun Life is the sixth-largest provider of group insurance benefits.
Sun Life has been accused of wrongful claim denial and other insurance bad faith conduct on many occasions. Sun Life’s disability insurance wing has been accused of betraying its fiduciary duties to customers by playing both sides of the table–they are responsible for paying disability benefits while at the same time holding responsibility for determining who is disabled and entitled to benefits. Sun Life affiliates have been hit with a class action in Canada for improperly calculating benefits to the detriment of policyholders, as well as for overcharging life insurance customers with hidden fees.
What Do I Do if Sun Life Denies My Life Insurance Claim?
If your life insurance claim has been denied by Sun Life, you have options. Consult with a seasoned life insurance denial attorney to discuss your claims and the steps you should take. Celebrated California life insurance denial law firm Gianelli & Morris has spent decades helping people like you collect the benefits you are owed after bad-faith claim denial by providers like Sun Life. We’ll help you collect the evidence necessary to challenge your claim denial, pursue an internal appeal, and file a civil lawsuit for damages where necessary.
At Gianelli & Morris, we’re more than familiar with the typical grounds for denial offered by Sun Life. We’ll help you fight back against your claim denial if your life insurance claim was rejected due to:
- Policy lapse. Insurers can terminate policies for nonpayment of premiums. However, they must follow strict notice and grace period rules before doing so. If Sun Life terminated your policy without giving you and your designee advance written notice and a chance to correct, you might still be entitled to benefits.
- Excluded cause of death. Sun Life may deny claims because the death was caused by suicide, criminal activity, a pre-existing condition, or other specific exclusions. Just because Sun Life claims that a death was excluded, however, does not make it so. They might reach a conclusion that is contrary to the medical evidence and their own policy language just to avoid paying out.
- Lack of evidence. Life insurance claims must be supported with proper evidence, including medical reports, police reports, autopsy reports, and other documentation. Often, a claim denial can be reversed simply by providing the missing documents and filling out the record.
- Errors in the application. Sun Life might try to “rescind” a policy if they discover misstatements in the original application, even if the policyholder has already died. In California, however, life insurance policies can only be rescinded within two years of activation or reinstatement; after the two-year “contestability” period, misstatements in the application cannot justify a denial of benefits. Moreover, any misstatement must be “material,” or important, to the policy–a typo or other minor error is not grounds for rescission.
