McHugh v. Protective Life Insurance Company

The Impact of McHugh V. Protective Life Insurance Company One Year Later

Attorney Robert Gianelli was recently interviewed for an article discussing the impact of the California Supreme Court’s decision in McHugh v. Protective Life Insurance Company. That decision ruled that California Insurance Code sections 10113.71 and 10113.72, dealing with an insurance company’s obligations to notify policyholders before a policy is allowed to lapse, applied to all policies in effect at the time the law was passed and not merely prospectively. The article referenced two cases pursued by Gianelli & Morris since the McHugh decision, and Mr. Gianelli commented on the necessity of such lawsuits in the face of insurance company refusals to comply with the law and the court’s ruling.
