Who Is United Omaha?

Mutual of Omaha is the modern remnant of Mutual Benefit Health and Accident Association, founded over a century ago in Omaha, Nebraska. Now, Mutual of Omaha is a Fortune 500 company generating more than $9 billion in revenue and managing more than $43 billion in assets. Mutual of Omaha and its various subsidiaries provide a number of financial services, including annuities, Medicare supplement insurance, long-term care insurance, and life insurance. Several of Mutual of Omaha’s subsidiaries, including United of Omaha Life Insurance Company and United World Life Insurance Company (United Omaha) provide life insurance.

Mutual of Omaha has been hit with several lawsuits alleging unscrupulous practices, including bad faith insurance conduct. Some of the most common reasons we see for denial of life insurance benefits include:

  • Failure to pay premiums. Insurers can terminate a policy or let a policy lapse if the premiums aren’t paid. California law, however, requires insurers to give plenty of notice well in advance of policy lapse, including notice to the policyholder as well as other parties appointed to receive notice of missed payments (typically, the beneficiaries and other family members). If United Omaha did not give its legally mandated notice, the policy cannot be terminated.
  • Misstatements in the application. Insurers can “rescind” a life insurance policy if the policyholder made “material misstatements” in their original application for benefits. However, rescission is only permitted by law within the first two years of the policy. If it’s been more than two years, United Omaha must pay out benefits, regardless of what’s in the application. The misstatements or omissions must also be “material,” meaning important to the policy–a simple typo cannot justify claim denial.
  • Lack of evidence in the record. If your claim is denied because of a lack of evidence supporting the claim, you have options for supplementing the record to fill the gaps. You do not get only one bite at the apple. Moreover, insurance companies often use “missing evidence” as a delay tactic, meant to bully you into accepting less than you are owed or giving up on your claim.   • Excluded cause of death. Some policies exclude certain causes of death. Just because United Omaha asserts that a death is excluded, however, does not make it so.
